Walt Disney World recently filed a flurry of 15 lawsuits against Orange County officials. This includes the Property Appraiser and the Tax Collector. The lawsuits contest over $105 million in property tax assessments for the 2025 tax year. Disney’s core argument is that the valuations are “excessive.” It claims this violates the Florida Constitution by exceeding the fair market value of the properties.
The Intangible Value Dispute
The central pillar of Disney’s legal complaint concerns professional appraisal practices. Disney alleges the Orange County Appraiser failed to use “professionally accepted appraisal practices.” Specifically, Disney claims the Appraiser improperly includes the value of intangible property in the real property assessment.
What constitutes this “intangible value”? These are assets like the Disney brand, goodwill, and skilled management that make the theme parks profitable. Disney argues these business assets should not be taxed as physical real estate. The contested properties include massive valuations for EPCOT ($794 million) and Magic Kingdom ($621 million).
Legal History and Financial Impact
Filing these property tax lawsuits is the company’s “modus operandi.” Disney has challenged its Orange County tax bills nearly every year for decades. This history is crucial because Disney recently secured a major legal victory over the 2015 and 2016 tax assessments.
That single ruling could entitle Disney to a tax refund of up to $80 million from Orange County. The financial stakes for the county are high. This could force agencies that rely on tax revenue, such as Orange County Public Schools, to refund a large amount of money. A spokesman for the Central Florida Tourism Oversight District (CFTOD) framed the ongoing legal battles as Disney’s strategy “to avoid taxes that pay for public education and other public services.” The current lawsuits seek to cement the legal precedent that prohibits taxing intangible brand value.
