Warner Bros. Considers Licensing DC Superheroes to Universal Studios

Preliminary talks between Warner Bros. Discovery (WBD) and Universal Studios are officially underway. The two companies are discussing licensing major DC heroes for new theme park attractions. This potential deal is the latest move in the global “superhero arms race.” Crucially, these negotiations create a massive domino effect. The outcome could fundamentally reshape the entire landscape of the Orlando theme park market.

The Ticking Clock: Marvel’s Contractual Restrictions

The high stakes revolve around Universal’s existing Marvel assets. Universal operates Marvel Super Hero Island at Islands of Adventure under a decades-old contract. That agreement severely restricts Universal’s creative freedom. Specifically, the park cannot use modern MCU characters or branding east of the Mississippi River.

This lack of flexibility prevents Universal from innovating with its most recognizable superhero property. Experts describe the current Marvel land as being creatively “frozen in time.” Universal struggles to expand or update the area using popular characters from the highly profitable Marvel cinematic universe.

DC’s Potential and Disney’s Ultimate Gain

The new DC deal offers Universal unparalleled creative freedom. It provides massive new properties like Batman, Superman, Gotham, and Metropolis. Universal could develop large, immersive, custom-built lands using this flexible IP platform. This move makes strategic sense for Universal as they look to build out new park sections.

However, the consequences of this shift favor Disney. If Universal chooses to close or re-theme the current Marvel land with DC content, the restrictive contract immediately reverts the rights to Disney. Disney would then gain full control of its most valuable IP—including characters like Spider-Man and the Hulk—for use in Walt Disney World parks. Universal gains creative flexibility with a massive new franchise. Disney gains control of its most valuable modern IP in its home market. This negotiation is positioned to reshape the entire Florida theme park landscape.
